Consultation opens on new rules for business partnerships

04 February 2022

Revenue Jersey has opened a consultation on proposals to change the way it works with partnerships and their partners.

The consultation outlines the proposed administrative changes as a result of the implementation of legislation to extend the Economic Substance requirements to partnerships.  Partnerships encompass all forms of legal partnerships, where more than one person undertakes a business activity together and shares risks and profits.  This ranges, for example, from a small husband-and-wife decorating business to large professional-services enterprises.

In addition, Revenue Jersey is also taking this opportunity to streamline the Jersey income tax reporting requirements for partnerships, which should create efficiencies for both partnerships and Revenue Jersey.

Feedback gained during the consultation process will help develop the plans for how Economic Substance requirements for partnerships are administered and how income from partnerships is reported, assessed and collected.

Richard Summersgill, Comptroller of Revenue, said: "We are keen to hear from all types of partnerships, the partners in such partnerships and industry bodies, as we develop our plans to administer the new legislation. Their feedback will be crucial to ensure the administration is as straightforward as possible for both partnerships and Revenue Jersey."

The full consultation document is available here and feedback should be sent to tax.policy@gov.je, with the subject heading 'Partnership consultation.' The consultation closes on 31 March 2022.
