Consultation Process:
The draft legislation on discrimination is the result of research that has been carried out by States departments and Committees since 1999. The Discrimination (Jersey) Law 200- (“DJL”) will impact on the whole Island community. Consultation on the DJL will be carried out in accordance with the new guidelines for consultation agreed by the States in Public Consultation RC82/2005. The consultation paper will be sent to the 300 organisations currently registered with the States Communications Unit on its Consultation Register.
A brief summary of the purpose of the consultation paper is to be found at the beginning. A more detailed explanation of the “DJL” and the Discrimination (Race) (Jersey) Regulations 200- (“the Race Regulations”) then follows.
Questions that consultees are asked to answer appear throughout the document but are also repeated in a questionnaire at Appendix 4. The Chief Minister’s Department is collecting all information provided in response to the questionnaire for and on behalf of the Home Affairs Department which is sponsoring the DJL and the Race Regulations.

A 14 week consultation period is being allowed. Responses must be received no later than 13th October 2006.
Confidentiality: Responses will be used to produce aggregate information only but unless marked “Confidential” opinions given in responses, including those submitted with no name or address, may be quoted in any report produced to demonstrate views that have been expressed during the consultation process. Names will not be quoted.
Responses will only be attributed to a named individual or organisation if the respondent has given express permission.
Once received responses will be collated and analysed and consideration given to making any changes to the DJL and the Race Regulations that are deemed necessary as a result of the consultation. If necessary a further round of consultation will be held.
Adoption of the legislation
The Minister for Home Affairs will present both the DJL and the Race Regulations to the States in the form of Projets for consideration and adoption. The Projets will include reports on the findings of the consultation process.
The DJL will be presented first and, if adopted by the States, it will then be sent to the Privy Council for Royal Assent before registration in the Royal Court. Once the DJL is registered the Race Regulations can be taken to the States for approval. It is hoped that the DJL and the Race Regulations will both come into force in the first half of 2007. However, as can be seen, these projections are subject to the time taken by the consultation and registration processes.
