About the consultation

The Government of Jersey is consulting on amendments to the Regulation of Care (Jersey) Law 2014.  These changes will introduce independent regulation and inspection of hospital and ambulance services in Jersey.

The draft Regulation of Care (Amendment) (Jersey) Law 202 (the “draft Law") is provided below.  This should be read in conjunction with the consultation document.​

The draft Law

Regulation of hospital and ambulance services is a continuation of a long-term project to regulate all health and social care providers in Jersey. This will bring Jersey into line with most other jurisdictions in the British Isles, where independent regulation and inspection has been part of the care sector for many years.

The draft Law would amend both the Regulation of Care (Jersey) Law 2014 (the “2014 Law") and the Regulation of Care (Standards and Requirements) (Jersey) Regulations 2018 (the “2018 Regulations").  These amendments would:

  • regulate hospital and ambulance services;
  • regulate those laser clinic services that are currently required to register under the Nursing Homes (Jersey) Law 1994 under the Regulation of Care (Jersey) Law 2014;
  • regulate hyperbaric oxygen therapy services;
  • amend the funding provisions for the Jersey Care Commission in relation to Government of Jersey provided services, its annual reporting and audit requirements;
  • amend the eligibility criteria for those who may be appointed as Care Commissioners, including the introduction of a maximum 9-year term limit; and
  • update aspects of the 2018 Regulations that affect all regulated care services.

How to submit comments to the consultation

Stakeholders are asked for their feedback on all Parts of the draft Law. As the draft Law amends the 2014 Law and the 2018 Regulations, it should be read alongside this existing legislation to be able to appreciate its effect.

This consultation will last for 8 weeks, commencing on 8 April until 3 June. You can give feedback by completing the survey.​​
