I understand that in 2012 or 2013 the States of Jersey commissioned accountancy firm KPMG to research the viability of Jersey developing an eGaming industry. Could I please be sent a copy of their report?

Response

It can be confirmed that KPMG did indeed carry out such a piece of work on behalf of the States.
The report includes the following clause as part of its Introduction:

"Our report is for the benefit and information of the addressees only and should not be copied, referred to or disclosed, in whole or in part, without our prior written consent, except as specifically permitted in our Engagement Letter."

It can be confirmed that the States has approached the Consultant to seek its permission to release a copy of the Report and this has been declined in writing.

Under Absolute Exemption 26 (a) and (b) of the Freedom of Information (Jersey) Law 2011, the States is therefore not in a position to comply with this Freedom of Information Request. Justification for exemption: information supplied in confidence.

Information is absolutely exempt information if:

(a)     it was obtained by the scheduled public authority from another person (including another public authority); and 
(b)     the disclosure of the information to the public by the scheduled public authority holding it would constitute a breach of confidence actionable by that or any other person.
