Request

We are requesting patient complaint data from Samares Ward, Overdale Hospital, between January 2008 and December 2016. Qualifying complaints would include any:

A

Safeguarding referrals

B

Internal investigations

C

Disciplinary actions

D

Informal patient complaints

E

Formal complaints through the Patient Advice Liaison System

F

Datixs

G

NHS warning letters in which abuse of a resident by a member of staff (agency or permanent) has been alleged.

We would ask that data be presented in a format with anonymised participants (Patient A, Staff Nurse 1, etc.) so as to be able to identify the frequency of multiple complaints by or against certain individuals.

Data need not identify particular dates but we would ask that it be presented by month or annually to identify trends, but preserve the right to privacy of those involved.

Response

Where numbers are small data has been amalgamated to reduce the possibility of identifying individuals. Article 25 of the Freedom of Information (Jersey) Law 2011 has therefore been applied.

There have been three safeguarding referrals made between 2008 and 2016.

B

There have been four internal investigations from 2008 and 2016 involving staff.

C

There were three disciplinary investigations between 2008 and 2016. These resulted in written warnings, dismissal and resignation.

D

There were three informal patient complaints submitted in 2016. There is no data for previous years.

The number of Complaints submitted between 2008 and 2016 are as follows:

• 2008 – 4 complaints

• 2009 – 3 complaints

• 2010 – 2 complaints

• 2011 – 2 complaints

• 2013 – 1 complaint

• 2016 – 1 complaint

There was 1 complaint made by a nurse to the Minister.

Article 25 – Personal Information

(1) Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2005.

(2) Information is absolutely exempt information if –

(a) it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2005; and

(b) its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.
