A list, by department, of all statutory functions in primary law or regulations that require, upon application, the issue of a licence or permit to a person or body for a given activity or function to be carried on lawfully by that person or body; together with a note of the requisite frequency of application (eg. annual, two yearly etc). Please would you include the date when the relevant statutory function was created and the date when it was last reviewed and the outcome of that review.

Response

Statutory functions in primary law or regulations that require, upon application, the issue of a license or permit to a person or body for a given activity or function to be carried on lawfully are already available in the public domain. The requestor is directed to the Jersey Law web site where a full list of legislation in Jersey is contained.

In relation to when each statutory function was last reviewed and the outcome of that review, the request is refused under Article 16 of the Freedom of Information (Jersey) Law 2011, namely that the cost of providing the information would exceed the fee prescribed by Regulation 2(1) of the Freedom of Information (Costs) (Jersey) Regulations 2014 that allows an authority to refuse a request for information where the estimated cost of dealing with the request would exceed the specified amount of the cost limit of £500. This is the estimated cost of one person spending 12.5 working hours in determining whether the department holds the information, locating, retrieving and extracting the information.

Refusal

Freedom of Information (Jersey) Law 2011:

16    A scheduled public authority may refuse to supply information if cost excessive

(1)    A scheduled public authority that has been requested to supply information may refuse to supply the information if it estimates that the cost of doing so would exceed any fee of an amount determined in the manner prescribed by Regulations for the purposes of Article 15.

Freedom of Information (Costs) (Jersey) Regulations 2014:

Regulation 2 Estimating the cost of supplying information

(1)    For the purposes of Article 16(1) of the Law, if the estimated cost of supplying information would exceed the specified amount, as determined in accordance with this Regulation and, if applicable Regulation 3, a scheduled public authority may refuse to supply that information.
