Foreword by Senator Paul Routier, President of the Employment and Social Security Committe (now Minister for the Social Security Department)

The Employment Law has been subject to considerable wide-ranging consultation and I am very grateful for the valuable input from all sections of the community. I am especially grateful for the work undertaken by the Employment Forum and JACS.

It is important to my Committee that our employment legislation is appropriate to Jersey and not imported wholesale from other jurisdictions. I am confident that the new Law will meet the expectations of most sections of the community and I hope that this document will provide a useful ‘good practice’ reference tool for employers and employees alike.

This handbook is based on the ACAS publication of the same name, adapted to reflect Jersey’s employment legislation. It provides a brief introduction to important employee relations topics and gives basic information on a number of subjects and where appropriate gives references to further sources of guidance.

The subjects are arranged in alphabetical order and the information is presented as far as possible in self-contained sections that can readily be consulted as the need arises.

The A to Z of Work is designed to give impartial advice on employment matters to employers and employees. It is based on the belief that the overall ethos in the workplace should be one of trust, co-operation and mutual respect. The very basic rights and duties of both parties are:

Employees’ Duties (and Employers’ Rights)

  • Employees should be honest, conscientious and loyal and should not act against employers’ interests.
  • Employees should be competent at their jobs and efficient.
  • They should not disclose confidential information about their employers’ business to others.
  • They should take care of their employers’ property and their own health and safety in the workplace.

    Employers’ Duties (and Employees’ Rights)

  • Employers should behave reasonably in employment matters at all times.
  • They should ensure that employees are properly skilled and trained to do their jobs.
  • They should practice good employee relations, ensuring that their employees know what is expected of them and what they can expect in return.
  • They should have clear disciplinary and grievance procedures.
  • They should pay their employees the agreed amount at proper intervals.
  • They should take reasonable care to ensure the health and safety of their employees.

    JACS provides a helpline, telephone 730503, which can answer most of your questions about employment relations matters including your legal rights and duties and our website www.jacs.org.je contains a great amount of detail, guidelines and model policies or procedures.

    JACS is committed to building better relationships in the workplace and offers a wide range of practical help for organisations through a regular programme of events.

    These events include interactive seminars for small firms with no HR specialist, seminars for larger organisations needing an in-depth approach and tailored training programmes run in individual workplaces.
