Subject:   PBA/1861 - Site of the Former Mont Mado Shed, La Rue de la Mare des Pres, St John – Proposed Sale
Decision(s): 
  1. The Minister approved, as recommended by Property Holdings:
 
  1. The acceptance of the highest tender received for the purchase of the site of the former Mont Mado shed, with each party to meet their own costs in passing the contract of sale before the Royal Court.
 
  1. That Nigel Terry Philpott and Marysia Philpott née Browarska, owners of Corner Cottage, be party to the Contract of Sale of the site of the former Mont Mado shed to the highest tenderer, so as to ratify the boundary between the site to be sold and the Philpott’s property (Corner Cottage), with each party (the Philpotts and the Public) to meet their own fees in connection with including the terms within the contract.
 
  1. That Mrs Enid Mona Davis, owner of 1, 2 and 3 Eileenid Villas, be party to the Contract of Sale of the site of the former Mont Mado shed to the highest tenderer, so as to grant formal drainage rights across the site to be sold, with each party (Mrs Davis and the Public) to meet their own fees in connection with including the terms within the contract.
 
  1. That as a condition of sale of the site to the highest tenderer, the Company will be obliged to extend an existing sewer ventilation pipe to a point just beyond the north boundary of the site, at its own cost, and with the agreement of the States of Jersey Transport & Technical Services Department.
 

 

Reason(s) for Decision: 

Under Standing Order 168 (1) (a), and 168 (3) the Minister hereby notified the States that he had accepted the recommendation of Property Holdings to agree to the above land transaction. 

Under Standing Order 168 (5) the Minister hereby authorised the Attorney General and the Greffier to pass any contract which is required to be passed on behalf of the Public.

Resource Implications: 

There are no financial implications other than those contained in the accompanying report, and there are no manpower implications.

Action required: 

In accordance with Standing Order 168 (3) this decision must be presented to the States at least 15 working days before the contract is passed.  After the expiry of 15 workings days following presentation to the States the transaction may be concluded. 

The Director of Property Holdings is to instruct the Attorney General and the Greffier to pass the necessary contract, and to copy this decision to the Minister, Treasurer and Deputy Treasurer.
