Please could you confirm how many staff in Social Services have signed non-disclosure agreements in the past three years on leaving their employment with the States of Jersey?
Of these, how many were permanent staff and how many were temporary?
Could you please confirm whether any agreements have been amended from the standard agreement template currently used by the States of Jersey, linked below, and if so please provide the number of non-standard agreements used and the relevant department that has used them?
Non-disclosure agreement
Could you please also confirm whether it is States policy for the “receiving party” to also retain a signed copy of the Non-Disclosure Agreement?
Response
The identified document is a non-disclosure agreement used when third parties are involved with the States of Jersey in a commercial discussion or potentially a recruitment process where there is no existing commercial, or employment relationship.
It is designed to provide both parties with clarity about the respective responsibilities that might accrue from information shared with them in the course of the commercial discussions, recruitment process or other similar exchange.
The use of non-disclosure agreements is not recorded in a reportable format and there is no policy with regards to whether the recipients retain a copy of agreement.
