Request

A
Following a visit by an Environmental Health officer to a rented property in each of 2015, 2016, 2017, 2018 and 2019, how many of these visits resulted in an improvement notice or a prohibition notice (as defined in article 9 of the Public Health and Safety (Rented Dwellings) (Jersey) Law 2018) or a precursor to such notice being served?

B
How many successful prosecutions have been brought under the Public Health and Safety (Rented Dwellings) (Jersey) Law 2018 (or any precursor thereto) in each of 2015, 2016, 2017, 2018 and 2019?

Response

A&B
There was no precursor to the Public Health and Safety (Rented Dwellings) (Jersey) Law 2018.

Minimum standards for rental dwellings were introduced on 1 December 2018 through the Public Health and Safety (Rented Dwellings – Minimum Standards and Prescribed Hazards) (Jersey) Order 2018.

Consequently, there were no legal notices relating to the above in 2015, 2016, 2017 and 1 January 18 – 30 November 18 because there were no minimum standards by which to require a property to be improved.

Environmental Health have served one notice since the legislation came into effect.

Since the introduction of the Public Health and Safety (Rented Dwellings) (Jersey) Law 2018 there have been no prosecutions under this law.
