Please provide copies of the training materials that are provided to government employees in respect of staff working in health that cover the rights of data subject access requests

A

All Government employees are required to complete the Data Protection Training on Virtual College and have access to the information available on the government intranet, My States. This information includes how to recognise a subject access request. Please see attached.

The Government of Jersey has a Subject Access Request Policy that is available to all employees on the government intranet, My States. Please see attached.

Handling Subject Access Requests

In order to protect the privacy of an employee, Article 25 of the Freedom of Information (Jersey) Law 2011 has been applied.

Article 25 - Personal information

(1) Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2018. 

(2) Information is absolutely exempt information if –

(a) it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2018; and

(b) its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.
