Response
A range of temporary public service employees, and companies, provide essential services that would be difficult to obtain quickly and when needed from within the permanent workforce. This was particularly true during the unprecedented level of policy and legislative work required to support the Covid-19 pandemic response. The use of Framework Agreements, such as the Policy Products Procurement Framework, is included as a requirement within the Public Finance Manual (Expenditure and procurement).

Mr Khaldi was previously engaged as an Interim Policy Director in Quarter 3 of 2020, in response to the unprecedented scale of public health policy development needed to support our community respond to the Covid-19 pandemic. At that time, he was engaged on a fixed term appointment. Please see the published response to a previous Freedom of Information request for further details, which can be accessed via the link below:
Appointment of interim Director of Public Health Policy (FOI)
Think. Do. Consulting Limited has been engaged to provide services to the Government of Jersey on important and urgent public health policy development matters. Mr Khaldi is described as an ‘Advisor’ in internal documents, including on his email signature (rather than a ‘Director’ within Government).

Think. Do. Consulting Limited was engaged through the Policy Products Procurement Framework. The company provided Mr Khaldi as the principal lead for this workstream.

The work was procured as a product for the provision of public health policy and advice, rather than an individual role within the public service.

The Policy Products Procurement Framework requires the lead official to detail the work required, which is then considered by and subsequently agreed with the most appropriate of the pre-approved companies.

Mr Khaldi is not an employee and is not filling a designated role within the public service and so a recruitment process could not have been undertaken.
