Please advise if any staff transferred from Government of Jersey employment to Ports of Jersey employment, since January 2021.

Of those staff that transferrred, how many maintained membership of the PEPS pension scheme?

Ports of Jersey is an arm’s length organisation and Government staff would be required to resign from their current position, as Ports of Jersey would be a completely new employer with new contracts and terms and conditions. 

The information you have requested is not held by the Government of Jersey. Article 3 of the Freedom of Information (Jersey) Law 2011 applies.   

However, it may be held by Ports of Jersey so you might wish to send your request in writing to:

It should be noted that Ports of Jersey are not a Scheduled Public Authority (SPA), therefore, they are not required to respond under the Freedom of Information legislation.

Any employees who left the employment of the Government of Jersey and are subsequently employed by the Ports of Jersey would have their pension records deferred. When they are employed by Ports of Jersey the pension record in the Career Average Scheme (PEPS) of the Public Employees’ Pension Fund is reopened and they continue to accrue pension on that record.

Article 3 - Meaning of “information held by a public authority”

For the purposes of this Law, information is held by a public authority if –

(a)     it is held by the authority, otherwise than on behalf of another person; or

(b)     it is held by another person on behalf of the authority.​
