Provision of 'Safer' Cells at HM Prison.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Provision of ‘Safer’ Cells at HM Prison.

Decision(s): The Minister agreed to seek the approval of the Treasury and Resources Minister, in accordance with Section 5.9 of Financial Direction 3.6, Variations to Heads of Expenditure, for a temporary budget transfer from an existing capital budget to be replenished from the prison future capital budgets in order to fund the provision of ‘Safer’ Cells.

Reason(s) for Decision: Following the reports by the Prison and Probation Ombudsman of England and Wales into the two deaths in custody that occurred in 2006 and early 2007, it was identified that the prison lacked adequate ‘safer’ cell provision.

As funding is not available for this project a temporary budget transfer is required from an existing capital budget in order to allow this urgent work to progress.

Resource Implications: None in the short term.  The status of all existing prison capital projects will be reviewed along with the capital projects detailed in the Draft Annual Business Plan 2008. (The relevant details of the 2010 Capital Programme can be found on pages 157 and 158 of the Annex to the Draft Annual Business Plan 2008 which notes that ‘a revision of the master planning programme for works beyond phase 3 is scheduled for later in 2007, which may require some reprioritisation of those schemes for which ‘in principle’ agreement is sought.’)

Action required: The Finance Director to pass the request to the Treasury and Resources Department for consideration by the Treasury and Resources Minister.
