Voluntary Redundancy: Transfer of Funds

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Minister approved:

  • the transfer of a total of £266,412 from the departments listed in the table below to the Chief Minister’s Department revenue head of expenditure for VR applications no longer going ahead:

  • the transfer of a total of £58,093 from the Chief Minister’s Department revenue head of expenditure to the departments listed in the table below to reflect the additional 2% cost of VR applications proceeding after 31st December 2010:

  • the transfer of the remainder of approved funding (£239,627) from P64/1010 for the VR scheme from the Treasury and Resources contingency to the Chief Minister’s Department revenue head of expenditure.

Reason(s) for Decision:  

MD-TR-2010-0159, signed on 12th November 2010, approved the initial allocation of £5,760,373 (out of the £6 million approved by the States in P64/2010) from Treasury and Resources to the Chief Minister’s Department, and onwards to departments, to meet the cost of approved voluntary redundancy payments. This decision makes further transfers to reflect:

  • transfer back of funding where VR applications are no longer going ahead;
  • uplift of previous transfers by 2% for agreed pay award where applicants are leaving after 31st December 2010; and
  • transfer of the balance of approved P64/2010 funding for VRs from the Treasury and Resources contingency to the Chief Minister’s Department revenue head of expenditure – this balance amounts to £239,627.

 

Article 15(1)(a) of the Public Finances (Jersey) Law 2005 permits the Minister for Treasury and Resources to approve that a head of expenditure may be used for the purposes of another head of expenditure.  This decision further implements the States’ approval of P64/2010.

Resource Implications:

There will be no increase to total approved States net revenue expenditure as a result of this decision.

Action required:

Head of Decision Support to inform the Head of Financial Performance Reporting that the transfers have been approved.
