About the consultation

The Chief Minister is consulting on proposals to replace the Jersey Appointments Commission (JAC) with a new independent body which will be known as the Jersey Public Appointments Commission.

The Comptroller and Auditor General published a report on the 'Role and Operation of the States Employment Board' in March 2019 setting out concerns that the existing statutory framework compromises the JAC's independence, and that the legislation does not provide a mechanism for meeting the costs of the Commission.

These proposals address those concerns by repealing Part 4 of the Employment of States of Jersey Employees (Jersey) Law 2005 and replacing it with a new standalone law that will:

  1. Establish the Jersey Public Appointments Commission as an independent body corporate to replace the present JAC
  2. Provide the new Commission with jurisdiction to oversee all appointments made by public authorities, excluding parishes and those appointments made by the States Assembly
  3. Enable the States to extend the functions and powers of the Commission by Regulations, in the future

These proposals are phase 1 of a number of proposed changes to the Employment of States of Jersey Employees (Jersey) Law 2005. It is envisaged that future phases will provide for matters relating to the functions of the States Employment Board and the role of the Chief Executive Officer.
