Hospital exclusion review

"As the Chair of SEB it is my job to ensure that the right systems are in place and are properly followed. I regret that the relevant procedure was not followed through properly in this case and that the consultant in question spent longer away from work than was necessary.

"The SEB fully accept the recommendations made in the report and is pleased to note that most, if not all, have already been followed up.

"The policy for the handling of concerns and disciplinary procedures relating to the conduct and performance of doctors and dentists has been incorporated into the employment contracts of appropriate staff. It was already standard for the BMA, but a copy was sent to all hospital doctors and dentists in April 2010 and everyone should now be aware of the proper procedure.

"Discussions are underway between SEB and the Law Officers Department, on the introduction of a Memorandum of Understanding similar to that which exists in the UK. A draft memorandum has been drawn up and consultation is now taking place with other parties, including the States of Jersey Police and the Health and Safety Inspectorate. We are aiming to finalise the agreement as soon as possible, to help us deal more quickly with any similar situations in future.

"All senior staff have been briefed on the policy for maintaining high standards within the health service and a full programme of training has been arranged so HR managers know exactly what is required of them when following  disciplinary procedures.

"Health and Social Services staff have re-established links with Wessex NHS and are attending quarterly meetings. This gives access to a network of expert advice on employee relations issues.

"There is a formal requirement for regular reports to be made to SEB on the progress of any suspension or exclusion.

"SEB is monitoring the thorough and speedy implementation of the recommendations from this report."
