If you break your Community Service rules

If you break your Community Service Order and need to return to court it is very important that you take legal advice as soon as possible. This will give your lawyer time to prepare for your court appearance.

Community Service Orders can be breached if you:

  • re-offend
  • fail to report to your appointment
  • fail to provide an acceptable reason for your failure to report
  • fail to notify the Community Service Team if you change address
  • leave Jersey without the permission of the Community Service Team
  • are violent or threatening violence
  • fail to obey instructions given to you by any person supervising your Community Service

If you break the rules of your Community Service Order you will either:

  • receive a warning
  • be issued with a compliance appointment or
  • be taken back to court

If you breach the order by failing or refusing to co-operate in any way your case will be returned to the court that sentenced you to Community Service.

If the breach is admitted or proved, the court may:

  • allow you to continue with the order, with or without a fine
  • sentence you to more hours of Community Service
  • cancel the order and send you to prison or youth detention instead
