About the consultation
We would like your feedback on the draft Competition (Mergers and Acquisitions) (Jersey) Order 202-.
Competitive and well-functioning markets help create the conditions for entrepreneurs and dynamic businesses to grow. To achieve this, we need a regulatory framework that is supportive and light-touch, yet strong enough to intervene effectively when required.
In November 2025, the States Assembly adopted the Competition Amendment (Jersey) Law 202-. This law updates the Competition (Jersey) Law 2005 . Its main aim is to help ensure that Islanders and businesses benefit as much as possible from effective competition in the economy.
For mergers and acquisitions, the changes seek to reduce administrative burden and costs for businesses. They will also allow the Jersey Competition Regulatory Authority to better focus its limited resources. A key goal is to ensure Jersey’s mergers and acquisitions rules:
- focus on local competition
- give businesses more certainty
- reduce administrative procedures
As the next step, we're asking for your views on the draft Competition (Mergers and Acquisitions) (Jersey) Order 202-, which would replace the Competition (Mergers and Acquisitions) (Jersey) Order 2010. To support the goals above, the draft Order introduces a new notification test based on local turnover, gives the Jersey Competition Regulatory Authority (JCRA) a call-in power, and sets out several appropriate exceptions.
