About this consultation

  • balance the interests of rights holders and people who use protected material
  • meet international treaty obligations
  • update how intellectual property rights are enforced

Consultation documents

Consultation Paper on amendments the Draft Intellectual Property (Unregistered Rights) laws

Annex A: Draft Intellectual Property (Unregistered Rights) (Jersey) Amendment Law 202-

Annex B: Draft Intellectual Property (Unregistered Rights)(Works of Foreign Provenance) (Jersey) Amendment Order 202-

About intellectual property protection

Intellectual property (IP) protection is a key part of modern economic policy which is increasingly driven by innovation and intangible assets. Ensuring that Jersey’s IP laws are modern and consistent with international standards is therefore an important policy objective for the Government.

The proposed package of amendments are intended to:

  • ensure compliance with relevant international treaty and trade agreement obligations;
  • facilitate the extension to Jersey of the WIPO Copyright Treaty and the WIPO Performances and Phonograms Treaty;
  • maintain an appropriate balance between the interests of rights holders and users of copyright material in a manner that promotes creativity, innovation and wider public benefit; and
  • modernise enforcement provisions to ensure that copyright and related rights can be enforced effectively, particularly in the digital age.
