About this privacy policy
This privacy policy explains how Health and Care Jersey (HCJ) processes personal data when managing Freedom of Information (FOI) requests.
HCJ is registered as a data controller under Data Protection (Jersey) Law 2018, and processes personal and special category data to deliver our services and support Islanders’ health and wellbeing.
HCJ also support transparency in public service by delivering a Freedom of Information (FOI) function and publishing data in response to requests for information relating to:
- our services
- our decision-making
- how we operate
Where HCJ delivers services and operates in conjunction with other Government of Jersey services and departments, we will liaise with them, where appropriate, to provide as full a response as we can.
Why we need your information
To fulfil your request for access to information, we must be able to contact you and so we'll ask for your name and contact details.
The Freedom of Information (Jersey) Law 2011 only applies to information about our services and decision-making, and we don't need to ask for any further information.
If you believe it adds context to your request, you may provide information that's personal in nature. We request you keep this information to a minimum and provide it knowing that your request will be shared with key partners and subject matter experts, if the information is key to providing a full and complete response.
How we use your information
We'll use the name and contact details you provide to:
- register your request and acknowledge receipt
- advise you of deadlines and deliver requests for extensions
- contact you if we need to clarify your request
- understand what information you need and in what format
- disclose the information to you
- liaise when you request an internal review
- consider whether requests are vexatious or repeated

Who has access to your personal data
Your information will be accessed by the HCJ FOI team which is responsible for responding to your request.
The HCJ FOI team will liaise with specialist service areas to source records, request the collation or provision of data. Subject matter experts can support the drafting of the response or provide expertise when considering the application of exemptions.
To maintain the integrity of the Freedom of Information process, we act applicant and motive blind. We treat all requests equally and do not give more or less access to information based on status, reputation, or reason for the request.
We will not share your name with those helping to collate your response.
Where we store your personal data
Your request and the disclosure we prepare for you in the response will be stored securely in the HCJ FOI records repository, on the Government of Jersey network and documented on the HCJ FOI Register.
