Employee disputes (FOI)

Employee disputes (FOI)

Produced by the Freedom of Information office
Authored by States of Jersey and published on 10 November 2016.

Request

How many disputes in both Education and Health have led to the formal grievance process and this in turn has led to time off work due to stress and possible mental health issues.

Response

Between January and September 2016, there have been a total of 19 grievances within the Education and Health and Social Services Departments from employee disputes.

Six staff involved are on sick leave where the reason for absence is “stress and/or mental health issues”.

Unfortunately, due to the low levels in departments, we are unable to break this down as this would risk the identification of individuals. As such the information is exempt under Article 25 of the Freedom of Information (Jersey) Law 2011.

Exemptions applied

Article 25 - Personal information

(1) Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2005.

(2) Information is absolutely exempt information if –

(a) it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2005; and

(b) its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.
