What progress, if any, has been made to date on extending the Freedom of Information law to companies wholly owned by the States of Jersey as voted on by the States assembly? Including the review that a previous request revealed would be completed by the first quarter of 2017.

When is the law expected to be extended to those companies by or if no fixed date is there a deadline and what is it?

Response

Article 23 of the Freedom of Information (Jersey) Law 2011 allows an authority to refuse a request where information is accessible to the applicant by other means.

Exemptions applied

Article 23 – Information accessible to applicant by other means

(1) Information is absolutely exempt information if it is reasonably available to the applicant, otherwise than under this Law, whether or not free of charge.

(2) A scheduled public authority that refuses an application for information on this ground must make reasonable efforts to inform the applicant where the applicant may obtain the information.
