Re-offending of HMP La Moye prisoners (FOI)

Re-offending of HMP La Moye prisoners (FOI)

Produced by the Freedom of Information office
Authored by Government of Jersey and published on 26 September 2019.
Prepared internally, no external costs.

Request

What are the HMP La Moye prisoner re-offending rates for the last five years

If they have a break down of how many veterans are locked up that would also be very useful (an average per year for the last ten years would be fine)

Response

The information requested is not routinely collected by the States of Jersey Prison Service. It would therefore require a significant amount of work to obtain the relevant data. It has been estimated that the cost of doing this work would exceed the cost limit for Freedom of Information requests.

Under Article 16 of the Freedom of Information (Jersey) Law 2011 (the FOI Law) a Scheduled Public Authority may refuse to supply requested information if it estimates that the costs of doing so would exceed an amount prescribed by Regulations.

The following link to the 2015 report into Community Sentences and their Outcomes which is available on the website www.gov.je  may be of use in relation to re-offending:

Community Sentences and their Outcomes

Please note that the Probation Service are not a Scheduled Public Authority under the FOI Law and are therefore not obliged to response to requests for information.

Article applied

Article 16 A scheduled public authority may refuse to supply information if cost excessive

(1) A scheduled public authority that has been requested to supply information may refuse to supply the information if it estimates that the cost of doing so would exceed an amount determined in the manner prescribed by Regulations.

Regulation 2 (1) of the Freedom of Information (Costs) (Jersey) Regulations 2014 allows an authority to refuse a request for information where the estimated cost of dealing with the request would exceed the specified amount of the cost limit of £500. This is the estimated

cost of one person spending 12.5 working hours in determining whether the department holds the information, locating, retrieving and extracting the information.
