Item 4 of the minutes of the meeting of the Parish of St Helier's Shadow Conseil Municipal held on 12th February 2020 refers to discussions that took place at that meeting on planning matters between members of the Shadow Conseil and Deputy John Young, Minister for the Environment.

A relevant extract from those minutes states as follows:

"The outcome of the discussions were, the Minister suggested that the Conseil map out what it would like achieve, which would give him and his Officers, the opportunity to consider the matter further. It was put to the Conseil that discussions should take place with the Minister and his team at Parish Officer Level, with possible involvement of members of the Conseil. It is hoped that the parties could report back to the May meeting with some proposals.
This was approved unanimously."

Please supply all written correspondence (including any corresponding reports, consultation papers etc. mentioned  or included in that correspondence) that has taken place between officers representing the Minister for the Environment on the one hand and officers representing the Parish of St Helier and its Shadow Conseil Municipal on the other, since 12th February 2020 to the date when this request is answered, where the subject of this written correspondence was the proposal to devolve some planning matters from central government to the Parish of St Helier's Shadow Conseil Municipal

Response

The Government of Jersey has not progressed this matter any further since the meeting on 12 February 2020 due to resources being utilised elsewhere as a result of the Covid-19 pandemic.

However, we have provided the following correspondence which has been redacted in accordance with Article 25 (Personal Information) of the Freedom of Information (Jersey) Law 2011. Items in the correspondence which do not relate to the subject requested have been redacted.

Article 25      Personal information

(1) Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2018.
(2)     Information is absolutely exempt information if –
(a)     it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2018; and
(b)     its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.
(3)     In determining for the purposes of this Article whether the lawfulness principle in Article 8(1)(a) of the Data Protection (Jersey) Law 2018 would be contravened by the disclosure of information, paragraph 5(1) of Schedule 2 to that Law (legitimate interests) is to be read as if sub-paragraph (b) (which disapplies the provision where the controller is a public authority) were omitted.
