Request

I hereby make two FOI requests to the Department of Infrastructure (the "Minister"), pursuant to Article 62(2), Article 65(5) of the Jersey Gas Company (Jersey) Law 1989 (the "Law") (attached for ease).

The Law sets out the obligations of Jersey Gas Limited (the "Company").

A

Article 62(2) of the Law stipulates as follows: The Declared Calorific Value at the commencement of this Law shall be the standard Calorific Power determined under the Loi (1989) sur la compagnie du gaz (now repealed) and in force immediately before the date; but the Company may alter the Declared Calorific Value by giving the Minister notice of its intention including the proposed new calorific value, and publishing a copy of the notice in one or more newspapers having circulation in the areas effected, at least three months before the alteration; and on expiry of that period the value as altered shall become the Declared Calorific Value. 

Referring the Article 62(2), I hereby request:

(i) Confirmation of the Declared Calorific Value ("DCV") at commencement of the Law, and

(ii) Copies of any and all notices of intention to alter the DCV that have been issued by the Company to the Minister from commencement of the Law to date.

B

Article 65(5) of the Law stipulates as follows: The gas examiner shall make a report every quarter of the results of the gas examiner's testing in pursuance of this Law to the Minister and the report shall be receivable in evidence.

Referring to Article 65(5), I hereby request:

Copies of the quarterly reports issued by the gas examiner to the Minister for the period 2002 to date.

Response

The Government of Jersey (GOJ) does not have on record the Declared Calorific Value (“DCV”) at the commencement of the Law.

The Minister or his Department has not received any notices of intention to alter the DCV.

B

The Minister or his Department has not received any quarterly reports from the Gas examiner.
