Request

A

I would like to know if there have been any investigations into bullying among staff members in the Government of Jersey's London Office in the last five years.

B

If any such investigations were performed by an individual outside of the Government of Jersey, I should like to know how much was spent on the investigation. Finally, I would like to know the outcome of the investigation. If a final report was produced, I would like to see it. Thank you.

Response

A

The Government of Jersey is aware of fewer than five investigations conducted into bullying among staff members in the Government of Jersey’s London Office during the past five years.

Where numbers are fewer than five, disclosure control is applied to avoid identification of individuals.  Article 25 (Personal Information) of the Freedom of Information (Jersey) Law 2011 has been applied.

B

Due to the small number of individuals involved, the release of details regarding any investigations, including the outcome of any investigations or reports may lead to the identification of individuals. Article 25 (Personal Information) of the Freedom of Information (Jersey) 2011 Law has been applied.

Information regarding costs associated with any investigations is not held and therefore Article 3 (Information held by a public authority) of the Freedom of Information (Jersey) 2011 Law has been applied.

Articles applied

Article 3 - Meaning of "information held by a public authority"

For the purposes of this Law, information is held by a public authority if –

(a)  it is held by the authority, otherwise than on behalf of another person; or

(b)  it is held by another person on behalf of the authority.

Article 25 - Personal information

(1)     Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2005.

(2)     Information is absolutely exempt information if –

(a)     it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2005; and

(b)     its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.
