As mentioned in the above document, I would like to request the following 


(3.6) Any minutes (or redacted minutes) of the quarterly meetings of the officer group formed by the Airport Director in 1994. 


(4.1) Any correspondence with the States of Jersey and the laboratory of the foam manufacturer in the United States between 1994-1995.


(4.1) Any correspondence with the States of Jersey and the United Kingdom laboratory (M-Scan) in 1998-2000.


(4.2) Any minutes (or redacted minutes) from meetings in September 2000 between the manufacturer scientists and Members of the Harbours and Airport Committee. 

I understand certain documents name the chemical constituents and the manufacturer. These names can be removed if they impede the release of these documents.

The Government of Jersey does not hold the requested documents; therefore, Article 3 of the Freedom of Information (Jersey) Law 2011 applies.


The minutes of the September meeting referred to are confidential, therefore the requested information is exempt from release and Article 26 of the Freedom of Information (Jersey) Law 2011 has been applied.

Articles applied

Article 3 - Meaning of “information held by a public authority”

For the purposes of this Law, information is held by a public authority if –

(a)     it is held by the authority, otherwise than on behalf of another person; or

(b)     it is held by another person on behalf of the authority.

Article 26 - Information supplied in confidence

Information is absolutely exempt information if –

(a) it was obtained by the scheduled public authority from another person (including another public authority); and

(b) the disclosure of the information to the public by the scheduled public authority holding it would constitute a breach of confidence actionable by that or any other person.
