Settlement agreements (FOI)

Settlement agreements (FOI)

Produced by the Freedom of Information office
Authored by States of Jersey and published on 21 September 2016.

Request

How much has been spent on settlement agreements, sometimes known as compromise agreements, in the past five years. Please also break the spending down by department, financial amount, and the number of people receiving the settlements.

Response

For the years 2011 to 2014, please refer to the link below to a previous Freedom of Information response:

States of Jersey number of staff compromise agreements and amounts paid for last 3 years (FOI)

The table below shows the breakdown of the agreements during 2015.

Due to low levels of agreements in some departments, Article 25 of the FOI Law (Jersey) has been applied to provide anonymity for individuals in those areas.

DepartmentTotalAmount
Department for Infrastructure21£690,917.20
Education, Sport and Culture15£1,125,596.39
Health and Social Services21£510,816.19
States Services*33£1,261,467.96
Total90£3,588797.74

*States services includes the following departments:

  • Chief Minister’s
  • Community and Constitutional Affairs
  • Department for Environment
  • Economic Development
  • Social Security
  • Treasury and Resources

Of the 90 agreements, 71 (78.9%) relate to the voluntary release scheme, which was launched in June 2015. The remaining 19 were in line with policy. Seven of the 19 were as a result of service re-design.

Example reasons for compromise agreements are:

  • where an employee leaves following a management reorganisation which dramatically changes their terms of employment
  • a breakdown of relationships to the extent that a swift resolution is necessary to ensure there is no detrimental effect upon services
