This guide has been written to try to explain the Bankruptcy (Désastre) (Jersey) Law 1990, as amended, and its associated rules in everyday language. Quite a lot has been simplified or omitted.
The 1990 law will be referred to as "the bankruptcy law" throughout the document.
The bankruptcy law was drafted over the course of many years, and the law itself must be read, and appropriate professional advice obtained, to get an accurate picture of what the désastres law is.
The bankruptcy law is quite complicated and, when enacted, brought Jersey into line with other advanced jurisdictions in this branch of the law.
