Residential and Employment Status: Control of Housing and Work (Jersey) Law 2012: Policy Guidance - March 2018

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Approval of updated Policy Guidance on Residential and Employment Status under the Control of Housing and Work (Jersey) Law 2012.

Decision(s): The Assistant Chief Minister approved a Report entitled Control of Housing and Work (Jersey) Law 2012 – Residential and Employment Status – Policy Guidance for presentation to the States Assembly.

Reason(s) for Decision: The Housing and Work Advisory Group (HAWAG) has approved revised and updated guidance relating to the determination of residential and employment status under Article 2 of the Control of Housing and Work (Jersey) Law 2012. This guidance is intended to update existing provisions and to confirm policy where it has not previously been published. The guidance has been developed and updated in order to ensure clarity and consistency of decision-making. Under Article 2, the Chief Minister is obliged to issue guidance relating to the effect on a person’s status of their temporary absence from Jersey and to present such guidance to the States. The new guidance will replace that currently in place in respect of temporary absence published under reference R.125/2016. and, to that end, it must therefore be presented to the Assembly. Publishing it in this manner will also allow for easier public access and understanding of the context in which decisions about status are made.  

Resource Implications: There are no resource implications of this decision.

Action required: The Greffier of the States to be provided with a copy of the Report and to be requested to arrange its presentation to the States as soon as practicable immediately prior to the making of the related Control of Housing and Work (Guidance on Temporary Absence and Significant Ownership) (Amendment) (Jersey) Order 2018.
