A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister for Planning and Environment confirmed the Listing of Beauport Dolmen (Dolmen de Fiquet), Field 574 nr La Verte Rue, St Brelade as a Site of Special Interest on the basis of its archaeological and historical interests subject to an amendment of the extent of the SSI such that the area to be so designated was reduced from a radii of 20 metres to one of 15 metres from the centre of the site.

The Minister also determined that that area of land between 15 -20 metres from the centre of the site be considered as part of the adjacent Area of Archaeological Potential

 

Reason(s) for Decision:

  1. The Minister has given due regard to the representations received and the additional information provided by Jersey Heritage Trust in light of the representations received;
  2. This decision gives statutory effect to that, with amendment, made on 12 July 2007 and;
  3. the special interests of Beauport Dolmen (Dolmen de Fiquet), Field 574 Nr La Verte Rue, St Brelade, as defined in the amended schedule and relative to the published criteria for selection, justifies its inclusion on the List of Sites of Special Interest in accordance with the provisions and purposes of the Planning and Building (Jersey) Law 2002 and;
  4. The decision accords with States Strategic Plan commitment of protecting and sympathetically managing the Island’s built heritage.

 

Resource Implications:

The designation of this site will require the archaeological interest of the site to be considered within the context of any works on the site which may require archaeological advice to be procured.

Purpose of the Report

The purpose of this report is for the Minister to confirm the Listing of Beauport Dolmen (Dolmen de Fiquet), Field 574 nr La Verte Rue, St Brelade as a Site of Special Interest.

 

Background

Beauport Dolmen was added to the Register as a proposed Site of Special Interest by the Jersey Building Heritage Sub-Committee during its review of St Brelade in July 2001 having been identified by the Sociètè Jersiaise Archaeology Section as one of the top 50 archaeological sites in the Island.

The Department was notified in early July 2007 that certain earthworks were being undertaken in close proximity to the site. Investigation proved that the works did not construe development and so no breach of the Planning Law had taken place. However, in the interests of protecting the dolmen from potential harm a delegated decision was made, by the Assistant Director – Policy and Projects, to provisionally List the site under the provisions of Article 53 of the Planning and Building (Jersey) Law 2002.  An appropriate Site Notice was posted and a letter of notification sent to known owner/s on 12 July 2002. A letter of representation was received on 4 August 2007 (attached) expressing concern that publication on the List of the location of the dolmen places the site at risk and impacts on the privacy on the land owner.

 

Discussion

The designation of the site has no impact on rights of access to property; therefore the owner is still at liberty to refuse entry to anyone not legally authorised to enter onto their land.

The Department is aware of the potential risk that raising awareness of the significance of a site and its location can bring; however the Law requires a set process of notification and publication to be followed in order to offer the sites an appropriate level of protection in accordance with Policy, Law and States Strategic objectives. This situation is therefore unavoidable.

 

Recommendation

It is recommended that the Minister for Planning and Environment confirms the Listing of Beauport Dolmen (Dolmen de Fiquet), Field 574 nr La Verte Rue, St Brelade as a Site of Special Interest on the basis of the special archaeological and historical interests attached to it and defined in the attached schedule.
