Fish Farming Licence - Aqua-Orchard Ltd.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister approved a licence for fish farming to be issued to Aqua-Orchard Ltd.

Reason(s) for Decision:

Following the authorisation by the Minister to allow publication in the Jersey Gazette (MD–E-2009-0135), the draft licence was advertised on 18 August 2009. The period during which any objections to the granting of this licence could be made expired on 18 September 2009. Although one objection was received, this was due to a misapprehension, and upon discussion with the complainant, the objection was withdrawn in writing.

Resource Implications:

This concession will be required to be sampled monthly by the Planning and Environment Department for classification for human consumption, as is the norm with all existing aquaculture concessions. As such, the Planning and Environment Department will incur a cost per sample, currently £36.85. Shipment costs are paid by Health Protection. This will increase the aggregate number of total samples taken for all existing inter-tidal concessions, for all aquaculture companies, from 17 to 18, approximately a 5.8% increase in cost. There is no cost implication for the Economic Development Department. The proposed location of this concession is close to an existing concession, and the States Veterinary Assistant has stated that the extra sample can be included in the current sampling routine with minimal addition in manpower or time costs.

 

Action required:

Fisheries Officers will issue the licence to the Aqua-Orchard Ltd subject to the conditions governing inter-tidal aquaculture
