Jersey Land & Property Index (JLPI): Agreement: Parish Rates Database 'Property Type' Extract Information

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment signed an agreement requesting from the Parish rates database ‘property type’ information for the development of the Jersey Land & Property Index (JLPI)

Reason(s) for Decision:

  1. The JLPI is a key States asset and including more detailed property type information will further enhance its value and be of further benefit to users. 
  2. Access to this specific information on the Rates system can be facilitated in compliance with the data protection legislation and will enable a more efficient and cost effective update process that might otherwise be significantly more time consuming and costly to undertake.

The States of Jersey Environment Department will cover all costs associated with extracting the data from the Parish Rates system. This would be a one off process undertaken by the system administrator. Future updates will be then maintained and updated by the mapping service team on a regular and continual basis from existing sources, primarily from the planning system.

Legal

This agreement is compliant with the Data Protection (Jersey) Law 2005 (‘the Law’). For the purposes of the JLPI, no data identifying individuals will be processed. Rates data held by the parishes constitutes personal data although names do not form part of this agreement. For the purposes of the Law, the parish will process (extract and disclose) the relevant data in accordance with paragraphs 5 and 6 of the Law. Both parties undertake to process all data in compliance with the Law in accordance with and for the purpose specified in this agreement. No further use or disclosure of the data is permitted other than with the consent of the data controller.

  1. Send a signed copy of the data agreement to the Comite des Connétables for their record.
