Island Plan: Interim Review: Housing and other policies.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment:

  1. resolved to propose the amendment of those polices in the Island Plan 2011 relating to housing (Polices H1-H11); Policy GD2: Demolition and replacement of buildings; and NR8: Safety zones for hazardous installations, and their reasoned justifications, together with other consequential amendments;
  2. authorised officers to announce and publicise his proposals to revise those parts of the 2011 Island Plan identified at 1. above and in MD-PE-2013-0083.

Reason(s) for Decision:

In respect of Island Plan polices relating to housing (Polices H1-H11) the Minister wishes to ensure that;

  • the Island Plan remains up-to-date and responsive to housing needs reflected in new Census and Housing Needs Survey data;
  • through the Island Plan, it is possible to operate a policy mechanism to effect the delivery of truly affordable homes to meet the Island’s housing needs;

In respect of Island Plan Policy GD2: Demolition and replacement of buildings the Minister wishes to ensure that the Island Plan contains policy that is capable of implementation to deliver stated policy objectives;

In respect of Island Plan Policy NR8: Safety zones for hazardous installations the Minister wishes to ensure that the Island Plan contains the latest data relating to these installations and the areas around them.

Legal and Resource Implications:

There are considered to be no legal and resource implications arising from the proposal to amend these policies. Further consultation with the Law Officers’ Department will be undertaken in the ongoing consultation in association with the Island Plan Review.

Action required:

Announce and publicise the proposal to amend the 2011 Island Plan and to undertake the necessary consultation and independent scrutiny of the proposed changes, as prescribed by law.
