Civil Status (Abolition of Legitimacy Etc.) (Jersey) Law 202-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Report Title: Draft Civil Status (Abolition of Legitimacy Etc.) (Jersey) Law 202-

Decision(s):

The Minister for Justice and Home Affairs decided to lodge 'au Greffe' the Draft Civil Status (Abolition of Legitimacy Etc.) (Jersey) Law 202- (the Draft Law).

Reason for Decision(s):

As work to bring the Children and Civil Status (Jersey) Law 2024 into force has progressed, it has become clear that the current position regarding the status of legitimacy is no longer aligned with modern family units and that continuing to label children as illegitimate is discriminatory.  Currently, only children born into a mixed-sex marriage have the status of legitimate.  Nearly 50% of children, including all children born to same-sex parents, are labelled as illegitimate. This is not equitable.  It is important to abolish legitimacy to bring the Children and Civil Status (Amendments) (Jersey) Law 2024 into force equitably.  The Minister for Justice and Home Affairs has worked with the Minister for Children and Families to lodge the Draft Law ahead of the Children and Civil Status (Jersey) Law 2024 being brought into force in Autumn 2025. This will abolish the status of legitimacy except for a small number of savings provisions regarding the succession of hereditary titles and manorial rights and to prevent retrospective actions. The Draft Law will remove discriminatory terminology relating to illegitimacy and repeal the following pieces of legislation: a) the Legitimacy (Jersey) Law 1963;  b) the Legitimacy (Jersey) Law 1973;  c) the Legitimacy and Illegitimacy (Re-Registration of Births) (Jersey) Regulations 1974; and  d) the Legitimacy Rules 1974.   This will ensure that no children are labelled based solely on the legal union of their parents.

Resource Implications: There are no financial or staffing implications arising from this decision.

 

Action Required: The Greffier of the States is requested to arrange for the Draft Law to be lodged 'au Greffe'.
