Health Care (Registration) (Prescribed Qualifications) (Amendment No. 5) (Jersey) Order 2012

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:   Health Care (Registration) (Prescribed Qualifications) (Amendment No 5) (Jersey) Order 2012.

Decision(s): The Minister for Health and Social Services made the Health Care (Registration) (Prescribed Qualifications) (Amendment No. 5) (Jersey) Order 2012.

 

The amendment to the principal Order sets out the prescribed qualifications required under Article 3(1)(b) of the Health Care (Registration)(Jersey) Law 1995 for the occupations of:

 

  • Midwife prescribing practitioner
  • Nurse prescribing practitioner
  • Specialist community public health nurse prescribing practitioner

 

In addition the principal Order is amended to update the prescribed qualification for registration as a Social Worker in line with the changes to the UK regulatory framework for Social Worker registration.

 

 

Reason(s) for Decision:    Change in UK regulatory framework for the registration of social workers and to support the implementation of non-medical prescribing in Jersey.

TITLE: Health Care (Registration) (Prescribed Qualifications) (Amendment No 5) (Jersey) Order 2012

BACKGROUND

 

Approval was given at a Ministerial briefing in May 2012 to amend the above Order and the Schedule to the Health Care (Registration) Law to support the introduction of non medical prescribing by adding three new registrable occupations.  Those being:

 

  • Midwife prescribing practitioner
  • Nurse prescribing practitioner
  • Specialist community public health nurse prescribing practitioner.

 

The States approved the regulation adding these occupations to the schedule on 23 September 2012. 

 

This Order sets out the prescribed qualifications for the above occupations by adding the following Articles to the Order:

 

5A1. Midwife prescribing practitioner

 

(a)  entry as a midwife in the register established and maintained under article 5 of the Nursing and Midwifery Order 2001 of the United Kingdom

 

(b)  notification on that register as a midwife independent prescriber or midwife supplementary prescriber; and

 

(c)   a reasonable degree of experience and of continuing professional development in prescribing prescription only medicines

 

5B1.  Nurse prescribing practitioner

 

(a)  entry as a registered nurse: first level in the register established and maintained under article 5 of the Nursing and Midwifery Order 2001 of the United Kingdom

 

(b)  notation on that register as a registered nurse: first level independent prescriber or registered nurse: first level supplementary prescriber and

 

(c)   a reasonable degree of experience, and of continuing professional development in prescribing prescription only medicines.

 

10A1. Specialist community public health nurse prescribing practitioner

 

(a)  entry as a specialist community public health  nurse in the register established and maintained under article 5 of the Nursing and Midwifery Order 2001 of the United Kingdom;

 

(b)  notation on that register as a specialist community public health nurse independent prescriber or specialist community public health  nurse supplementary prescriber and

 

(c)   a reasonable degree of experience and of continuing professional development in prescribing prescription only medicines.

 

 

The Order also amends the prescribed qualification for the occupation of Social Worker to update the legislation in line with changes in the UK regulatory framework for the registration of Social Workers. 

 

As from the 1 August 2012, the General Social Care Council (GSCC) was disestablished and the responsibly for registration of Social Workers transferred to the Health and Care Professions Council (HCPC) previously known as the Health Professions Council (HPC).  This was as a result of provisions in the UK Health and Social Care Act 2012.

 

Under the Jersey Law social workers were registered by virtue of their registration with the GSCC.

 

To ensure the proper registration of health and social care workers under Jersey Law the Order has been amended to include the following:

 

Article 1 amended to state ‘Health Professions Order’ means the Health and Social Work Professions Order 2001 of the United Kingdom

 

Entry numbered 10AC in the Order substituted with the following: ‘Social Worker - Registration in the part of the register, established and maintained under article 5 of the Health Professions Order, relating to the social work profession in England’
