Sea View Farm, Le Mont Cochon, St. Helier - Building of Local Interest

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment determined that Sea View Farm, Le Mont Cochon, St Helier be retained on the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey as a Building of Local Interest but that the particular interest of the building extend to the two ranges of outbuildings and the entrance gates only.

Reason(s) for Decision:

The particular interest of Sea View Farm, Le Mont Cochon, St Helier, extending to the two ranges of outbuildings and the entrance gates, but where the west range of outbuildings is of group value only, as identified and described in the report and relative to the published criteria for selection justifies its retention on Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey as a Building of Local Interest.

Legal and Resource Implications:

The inclusion of buildings and places in the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey is consistent with the purposes of the Planning and Building (Jersey) Law 2002.

Purpose of the Report

To enable the Minister to determine the status of Sea View Farm, Le Mont Cochon, St Helier on the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey.

 

Background and discussion

Sea View Farm is already registered as a Building of Local Interest by virtue of the east and west ranges of outbuildings and the entrance gates being defined as being of particular interest. As a result of development proposals the status of the site has been the subject of a review.

 

The review, undertaken by Jersey Heritage with the provision of additional advice from the Ministerial Registration and Listing Advisory Group, has concluded with a recommendation that whilst the site should be retained on the Register as a Building of Local Interest, such that the east range of outbuildings and entrance gates of Sea View Farm are of particular interest, as set out in the Jersey Heritage survey and report, the farmhouse and west range of outbuildings contribute to the group value of the farm complex only.

 

Notice of the proposed amendments to the nature of the Registration have been served on the owner, in response to which a representation has been received (dated 21 September 2010), as set out at appendix 2.

 

The principal objection that is material to the Minister’s consideration of this matter at this time is that the farmhouse has been deemed to be of interest to the group value: this is considered by the supplementary report, prepared by Jersey Heritage, dated 25 October 2010, at appendix 3.

 

Other matters raised in the representation, such as the potential implications of the extent of heritage interest at the site for development proposals, are not material to the Minister’s decision at this time and can only be considered within the context of a planning application.

 

Legal and resource implications

The inclusion of buildings and places in the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey is consistent with the purposes of the Planning and Building (Jersey) Law 2002.

 


Recommendation

The Jersey Heritage recommendation is that, notwithstanding the representations made, the farm group and gateway of Sea View Farm, Le Mont Cochon, St Helier be retained on the Register as Buildings of Local Interest, as set out in the report.

The particular interest of Sea View Farm, Le Mont Cochon, St Helier, as identified and described in the report and relative to the published criteria for selection, justifies its inclusion on Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey as a Building of Local Interest.
