Jersey Data Protection Authority: Reappointment of Members

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reappointment of members of the Jersey Data Protection Authority

Decision:

The Assistant Minister for Economic Development, Tourism, Sport and Culture (to whom the Minister has delegated responsibility for data protection) decided to reappoint Clarisse Girot, Gailina Liew and David Smith as members of the Jersey Data Protection Authority (the Authority). He decided to notify the States Assembly in accordance with Article 3(4) of the Data Protection Authority (Jersey) Law 2018 and present a Report to the States.

Reasons for Decision:  

Clarisse Girot, Gailina Liew and David Smith were initially appointed for a three-year term of office which commenced on 29 October 2018. They may serve for a total of nine years.

 

After undertaking a ‘Peer Review and Skills Assessment’ and having worked with the three members for nearly three years, the Chairman of the Authority has written to the Assistant Minister to advise he is happy and confident to request their reappointment. Ms Girot and Ms Liew have agreed to 3 years for the extension to their term of office, Mr Smith has requested 2 years. The shorter term requested for Mr Smith, combined with the fact that the first term for the other two members of the JDPA ends on 31 July 2022, is to allow for staggered recruiting and reappointing whilst ensuring continuity and stability.

Resource Implications: The Government provides the Jersey Office of the Information Commissioner with an annual grant to regulate the Data Protection (Jersey) Law 2018. The fees payable to members of the Authority are sourced from the annual grant. There are no other financial or manpower implications arising from this decision.

Action required:  The Greffier of the States is requested to arrange for the attached Report to be presented to the States.
