Budget Transfer from Restructuring Provision to Community and Constitutional Affairs: States of Jersey Police Mobile Technology Project (SMARTPolice)

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

The allocation of funding to Community and Constitutional Affairs from the Restructuring Provision.

Decision(s):

The Minister agreed to request the approval of the Minister for Treasury and Resources for a budget transfer of £1,220,000 across the years 2017 and 2018 from the Restructuring Provision to the Community and Constitutional Affairs minor capital head of expenditure to fund the States of Jersey Police Mobile Technology Project (SMARTPolice).

Reason(s) for Decision:

Article 17(2) of the Public Finances (Jersey) Law 2005 states that the Minister for Treasury and Resources is authorised to approve the transfer from contingency expenditure or the insurance fund of amounts not exceeding, in total, the amount available for contingency expenditure in a financial year.

The Contingency Allocation Policy published by the Minister for Treasury and Resources (R.10/2012) states that all requests for Allocation from Contingency will be considered by the Council of Ministers and this restructuring provision bid was approved at its meeting on 9 December 2015 and 8 February 2017.

Resource Implications:

This decision will result in the Community and Constitutional Affairs minor capital head of expenditure increasing by £1,220,000 in total across the years 2017 and 2018 and the Restructuring Provision to decrease by an identical amount.

This decision does not change the total amount of expenditure approved by the States for 2017 – 2019 in the Medium Term Financial Plan.

Action required:

The Head of Decision Support, Treasury and Resources, to advise the Finance Director, Community and Constitutional Affairs that the request has been approved.
