Committee of Inquiry into Historical Abuse: Appointment of Chairman

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Committee of Inquiry into Historical Abuse - Appointment of Chairman:  Lodging ‘au Greffe’ of Proposition.

Decision(s):

The Chief Minister approved the Report and Proposition recommending that Mrs Sally Bradley QC be appointed as Chairman of the Committee of Inquiry into Historical Abuse and agreed that it should be lodged ‘au Greffe’ once the public announcement by the Greffier about the proposed appointment of Mrs Bradley had been made on Wednesday 13th June 2013.

Reason(s) for Decision:

The States agreed on 6th March 2013 that a Committee of Inquiry into Historical Abuse should be established and charged the Greffier of the States to work with 2 independent people from the United Kingdom to identify a suitable person to act as Chairman for the inquiry. The Greffier of the States wrote to the Chief Minister on 6th June 2013 setting out how the recruitment process had been undertaken and recommending that Mrs Sally Bradley QC should be nominated for appointment by the States.

Resource Implications:

The proposition relating to the establishment of a Committee of Inquiry (P.118/2012) stated that the inquiry could cost up to £6m. The terms agreed with Mrs Bradley are within with the amounts specified for the Chairman’s role in the comments of the Minister for Treasury and Resources (P.118/2012 Com(2)).

Action required:

The Greffier of the States is requested to lodge ‘au Greffe’ the Report and Proposition recommending the appointment of the Chairman of the Committee of Inquiry for debate by the States during the States meeting of 16th July 2013.
