Budget transfer within Department for Infrastructure: Liquid Waste Strategy

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: The transfer within the Department for Infrastructure (“DfI”) of £7,000,000 in 2018 from the Infrastructure Rolling Vote capital head of expenditure (Q00RL10011) to the Liquid Waste Strategy head of expenditure (Q00BT14022).
Decision(s): The Minister approved the transfer of £7,000,000 in 2018 from the DfI Infrastructure Rolling Vote capital head of expenditure (Q00RL10011) to the DfI Liquid Waste Strategy head of expenditure (Q00BT14022).
Reason(s) for Decision: Article 18(1)(c) of the Public Finances (Jersey) Law 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure. The new Liquid Waste Strategy has been funded from a number of different sources including an annual contribution from the Department for Infrastructure capital head of expenditure since 2014. A decision (MD-T-2018-0010) was signed by the Minister for Infrastructure on 5th February 2018.
Resource Implications: The DfI Infrastructure Rolling Vote capital head of expenditure (Q00RL10011) to decrease by £7,000,000 and the DfI Liquid Waste Strategy capital head of expenditure (Q00BT14022) to increase by £7,000,000. This decision does not change the total amount of expenditure approved by the States for 2017-2019 in the Medium Term Financial Plan.
Action required: Head of Decision Support to advise the Finance Manager - Department for Infrastructure once this decision has been approved.
