Cold Weather Bonus and Payments (Amendment - Extension of Eligibility) (Jersey) Regulations 202-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Social Security decided to lodge the Draft Cold Weather Bonus and Payments (Amendment - Extension of Eligibility) (Jersey) Regulations 202-, for debate at the States sitting on 16th January 2024.

Reason for Decision(s):

In October 2023, the States Assembly approved Deputy Poree’s amended Proposition P.64/2023. These Regulations seek to implement that decision by extending eligibility under two separate schemes that provide cold weather support to local low-income households.

Resource Implications: It is difficult to provide an accurate estimate of the cost of the expansion of these two schemes. There are approximately 250 working age individuals receiving a 100% Long Term Incapacity Allowance (LTIA) award. The household income of these individuals is not known so it is not possible to estimate the number of additional households that will qualify. Each new household that qualifies for support will receive a total of £210 from January to March 2024. If eligibility continues, the household will receive further support from October 2024, based on the temperature of each cold weather month. The cost of the additional payments will be met from the Customer and Local Services (CLS) tax funded benefit budget.    For example, if 50 additional households are eligible and apply for support, the total cost for 2024 would be approximately £20,000. These costs are provided for in the 2024 CLS cash limit.    There are no manpower implications arising from this Proposition.

 

Action Required: Private Secretary to request the Greffier of the States to arrange for the draft Regulations to be lodged with the States Assembly for debate at the sitting on 16th January 2024.
