Jersey Teachers' Superannuation Fund Management Board: Recommendation for new Board appointment to the Chief Minister

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Recommendation to the Chief Minister to appoint a nominee to the Jersey Teachers Superannuation Fund Management Board (as detailed in the attached report).

Decision(s):

 

The Minister for Children and Education recommended to the Chief Minister the appointment of Mr Michael De La Haye OBE to the Management Board of the Jersey Teachers Superannuation Fund.

 

Reason(s) for Decision:

 

Under the Teachers’ Superannuation (Administration) (Jersey) Order 2007 Article 3 – Appointment of members of Management Board, the Chief Minister shall appoint to be members of the Management Board:

 

6 Employer representatives of whom –

 

  • 2 shall be persons recommended by the Minister for Treasury and Exchequer;
  • 2 shall be persons recommended by the Minister for Education;
  • 2 shall be any persons that the Chief Minister thinks fit; and

 

6 Member representatives, who shall have been selected in the manner that the Chief Minister shall agree with the associations that appear to the Minister for Education to represent the interests of teachers.

 

Members of the Management Board shall hold office for 3 years and shall be eligible for re-appointment. The Chief Minister may at any time remove from office any member of the Management Board appointed by him or her under this Article.

 

Following a recruitment process the Minister for Children and Education recommends the following nominee to the Chief Minister:

 

  • Michael De La Haye OBE

Nominations to the Jersey Teachers Superannuation Fund (JTSF) Management Board

 

 

  1. Purpose of the Report

 

1.1.      The Minister for Children and Education is asked to recommend Mr Michael De La Haye OBE to the Chief Minister for appointment to the Management Board of the Jersey Teachers’ Superannuation Fund (JTSF).

 

  1. Background

  1. Process

 

3.1. Employer nominees are selected following a formal recruitment process under the Appointment Commission Guidelines. A position on the JTSF Management Board has become available following the resignation of Terry Le Sueur.

 

3.2. The honorary position was advertised and following a panel interview involving the Director of Finance Hub, Manager – Pensions Administration and the Secretary to the JTSF Management Board, Mr Michael De La Haye OBE was selected.

4.1. For the Minister for Children and Education, to recommend the nomination of Mr Michael De La Haye OBE to the Chief minister to join the Management Board of the Jersey Teachers’ Superannuation Fund for the period 1 January 2022 to 31 December 2024,

APPENDIX A

 

EMPLOYER NOMINEE – MR MICHAEL DE LA HAYE OBE

 

 

Michael de la Haye was educated in Jersey and at the University of Nottingham and worked in Tunisia and France before returning to Jersey in 1986 to work at the Immigration and Nationality Department. He moved to the Law Officers' Department in 1994 as Chief Clerk and then transferred to the States Greffe in 1999. He was appointed as Deputy Greffier of the States in 2000 and Greffier of the States in 2002, a post he held for 13 years until December 2015.

 

After leaving office as Greffier he was a Commissioner of the Jersey Financial Services Commission for 3 years.

 

From 2019 to 2021 Mr de la Haye chaired the Housing Policy Development Board established by the Chief Minister and he is currently a member of the Strategic Housing Partnership and a member of the Steering Group for the Housing and Homelessness Project.

 

He is a Lay member of the Employment and Discrimination Tribunal and a Trustee of the Les Vaux Housing Trust. In 2020 he was appointed as a member of the Independent Panel overseeing the work of the Citizens' Jury on Assisted Dying. Since January 2019 he has been a Pensioner Representative on the Committee of Management of the Public Employees Pension Fund and he chairs the Audit sub-committee. Mr de la Haye is an Associate of the Chartered Governance Institute and he was awarded an OBE in June 2014 for services to the States Assembly and the Commonwealth Parliamentary Association.
