Bus Services: Proposals from 2 January 2013

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Proposals for bus services to commence on 02 January 2013

Decision(s):  The Minister, having provisionally approved changes to the existing bus timetable as shown in the accompanying report, determined that public notice of his provisional decision should be given in accordance with Article 24 of the Motor Traffic (Jersey) Law 1935.

Reason(s) for Decision:  The changes being proposed are the first stage in a programme designed to overhaul the established bus network after many years of insubstantial change.  The alterations are necessary in order to increase bus capacity and encourage ridership increase, both CT Plus and TTS being fully committed to a process of continual improvement with the aim of achieving by 2015 the modal share targets set out in the States’ Sustainable Transport Policy.

 

Resource Implications:  The proposed bus service alterations form part of the provisional timetable included within the HCT final tender submission, approved by the Minister on 06 July 2012 (MD-T-2012-0052 refers).  Therefore there is no additional cost relative to the agreed contract price.

Action required:

  1. Advise CT Plus of the decision.
  2. Prepare advertisement to be placed in the Gazette section of the JEP and media release.
  3. Circulate proposals to all Constables, Parish Halls and other interested parties.
  4. Contact the Parish of St Saviour in respect of the width restriction affecting Service 20.
  5. Revert to the Minister for a final decision once the notice period has expired.
