Island Plan 2011: Policy Review: Coastal National Park and Green Zone

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment resolved to:

  1. propose the amendment of those polices in the Island Plan 2011 relating to the Coastal National Park (NE6) and the Green Zone (NE7), and their reasoned justifications;
  2. propose the consequential amendment of Island Plan Policy NR9: Utilities infrastructure facilities;
  3. publish the response to consultation on the draft supplementary planning guidance for Policy NE6: Coastal National Park, issued by the Minister in May 2012, in addition to the background for the wider review of policy.

Reason(s) for Decision:

In respect of Policy NE6: Coastal National Park, having had regard to the outcome of consultation on draft supplementary planning guidance; Royal Court judgements; and the application of policy since its adoption in 2011, the Minister wishes to provide:

  • greater clarity and comprehensiveness about the planning policy regime that will apply here;
  •     a stronger protection regime
  • explicit recognition that some minor incidental development may be acceptable but that this ought to be brought within greater control, through the removal of some permitted development rights, and that there will be a presumption against the development of ancillary buildings in the CNP;
  • explicit recognition that some strategic development may be required in the CNP.

In respect of Policy NE7: Green Zone the Minister wishes to provide a consistency of approach for policy in the countryside; and

In respect of Policy NR9: Utilities infrastructure facilities, this is a consequential amendment as a result of proposed change to Polices NE6 and NE7.

Legal and Resource Implications:

There are considered to be no legal and resource implications arising from this proposal to amend Policy NE6 and NE7. Further consultation with the Law Officers’ Department will be undertaken in the ongoing consultation in association with the Island Plan Review.

Action required:

  1. Incorporate the proposed amendment of Policy NE6: Coastal National Park, and Policy NE7: Green Zone, and that proposed for Policy NR9: Utilities infrastructure facilities into the proposal to amend the 2011 Island Plan and to undertake the necessary consultation and independent scrutiny of the proposed changes, as prescribed by law;
  2. Publish the response to consultation on the draft supplementary planning guidance issued by the Minister in May 2012, in addition to the background for the wider review of policy.
