A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Purchase of No 6 & 7 Springfield Crescent (former Roseneath)

Decision(s):

 

1. With reference to the previous decision MD-PH-2012-0049 plus associated documentation, the Minister approved, as recommended by Jersey Property Holdings, the acquisition by the Public of Nos 6 & 7 Springfield Crescent

 

  1. The Minister instructed Jersey Property Holdings (JPH) to advise the trustees of the Nemo Trust, as current owners, of the in principle decision and progress terms for the acquisition.

 

Reason(s) for Decision:

 

1. The Heath and Social Services Department (H&SSD) has identified the assets as an opportunity to provide appropriate additional accommodation to improve the lives of homeless people in Jersey.

 

2.  The proposals will release existing publicly owned building/s for reuse either by the States or third sector agency or for resale to achieve a capital receipt.

 

3.  Under Standing Order 168 (1) (a) the Minister hereby notified the States that he had accepted the recommendation of Jersey Property Holdings to agree to the above land transaction.

 

Resource Implications:

 

  1. The costs of acquisition will be borne by the H&SSD from funding approved from the Central Reserve.

 

  1. Operating costs of the new facility will be met from within existing H&SSD budgets.

 

Action required:

 

1. The Minister hereby authorised the Director of Jersey Property Holdings to pass any contract which is required to be passed on behalf of the Public.
