Teachers Terms and Conditions 2011 - Funding Request from Central Reserves

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Request for funding from Central Reserves for Teachers Term & Conditions in 2011.

Decision(s):

The Minister decided to allocate £500,000 to meet the costs of the increased time for teachers planning, preparing and assessing in 2011 from the T&R Central Reserves to Education, Sport & Culture under Article 15(1)(a) of the Public Finances (Jersey) Law.

Reason(s) for Decision:  

As part of the negotiations between the States Employment Board and the Teachers Associations concerning the salaries and terms and conditions of teachers in Primary, Secondary and Special Education for the period 1st January 2010 to the 31st December 2011, changes were agreed to non-teaching time for planning, preparing lessons and assessing pupils from the 1st January 2011 and to lunch time supervision from 1st January 2012.

 

Council of Ministers agreed via CSR Part 2 proposals that the funding implications, amounting to £800,000 will be met from central contingency with specific reference to 2011. There is a shortfall in funding in 2011 amounting to £500,000.

 

The annex to the Budget 2011 – ‘Comprehensive Spending Review – 2012 and 2013 Proposals’ (pg 30 and 31) states: “£800k ESC growth for Primary Teachers Terms and Conditions to be funded from central contingency”.

 

Article 15(1)(a) of the Public Finances (Jersey) Law 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure.

Resource Implications:

The T&R revenue head of expenditure to decrease by £500,000 and the Education, Sport & Culture Department revenue head of expenditure to increase by an identical amount. 

 

This decision does not change the total amount of expenditure approved by the States for 2011.

Action required:

Ministerial Decision to be approved by the Education, Sport & Culture Minister to accept the budget transfer.

 

Head of Decision Support to notify Assistant Director – Finance – Education, Sport & Culture that this decision has been approved.
