On 19th May 2006 a building application was received by the Department to carry out works at Ashton House, No. 104, Rouge Bouillon, St. Helier, including the installation of a spiral staircase between the 1st and 2nd floors. This was approved.
On 17th January 2007 Miss S. Read Building Control Surveyor visited the site and found that various works had been undertaken that did not accord with the approved plans, including the installation of conventional stairs from within a room on the 1st floor leading up to the 2nd floor.
These stairs are in breach of development controls in that:-
1) They do not conform to the Building Bye-Laws in respect of the height and the depth of the tread; the lack of a handrail; and that they start from a 1st floor room that is deemed by the Building Control Department not to be a ācirculation spaceā but to be a āroomā as defined by the Fire Safety Document (Approved Document B.)
2). Prescribed building work has been undertaken otherwise than in accordance with plans approved for the purpose of granting building permission (Article 39 (5) Planning and Building (Jersey)(Law, 2002.)
The Building Control Department has attempted to secure the owners compliance, but without success. It is therefore requested that an Enforcement Notice be served in order to remedy this situation by requiring that the following steps be taken:-
i). The removal of the un-authorised, non-compliant stairs leading from within the first floor proposed kitchen to the second floor room (Bedroom 5)
and;
ii). The creation of a stairway from the first floor landing to Bedroom 5 on the second floor, as per the approved plans (B/2006/0539C.) ,
