William Knott / Poplars Buildings, Overdale, St. Helier: Remodelling: Approval of Drawings and Acceptance of Tender

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

(a)  In accordance with Standing Order 168 (1d) “the approval of plans for the construction or alterations of buildings where the work is to be funded wholly or partly by money voted by the States”, the Minister decided to approve the drawings and specifications listed below all showing the proposed works to remodel internally the existing William Knott/Poplars Buildings at Overdale, as recommended by Jersey Property Holdings.

(b)  The Minister agreed to accept the lowest fix price tender submitted by Hacquoil & Cook Ltd. in the sum of £2,310,384.37 for the alterations and re-modelling of the two semi-detached buildings; and enter into a formal JCT IFC84 Form of Building Contract.

Reason(s) for Decision:

The drawings noted in item (a) above and which Planning and Bye-Law approval have been granted (Permits P/2016/0369and B/2016/0268 refer) reflect the use for which the funding is provided.

The estimated total cost for the works for all elements (including the lowest tender received, professional fees and other costs), as designed, can be completed within the allocated budget.

The complete details of all aspects of the project are captured in the Project Element Delivery Plan.

The lowest fix price tender submitted by Hacquoil & Cook Ltd in the sum of £2,310,384.37 can be accepted and a 42 Week Contract entered into.

The Project funding was approval at the H&SS Hospital Feasibility Project Board Meeting on 02 December 2015

The Overdale Working Group subsequently signed off the Project Element Delivery Plan on 15 December 2015.

The Director of Estates JPH to finalise the pre-contract details and to sign the Contract and any other associated documentation.

Resource Implications:

 

The budget is comprised of monies from existing allocations to JPH as part of the Future Hospital Budget.

Other than those noted in the report and Delivery Plan, there are no further financial or manpower implications respect of this decision.

 

Action required:

 

Under Standing Order 168 (5) the Minister hereby authorised the Attorney General and the Greffier to pass any contract which is required to be passed on behalf of the Public.
